Invasive plants - especially Japanese knotweed - are a major programme and legal risk on Irish construction sites. Moving contaminated soil without control spreads the plant and breaches the law. Why invasive species stop construction

For a contractor, an invasive plant like Japanese knotweed is not a gardening problem - it is a programme risk. Knotweed rhizome spreads up to 7m and 2-3m deep, and a fragment as small as a centimetre starts a new colony. The moment a digger moves contaminated soil across a site, the problem multiplies and the costs escalate. There are also hard legal duties: it is illegal to spread knotweed, and moving contaminated soil off-site needs an NPWS licence under EU Regulation 1143/2014 and the Wildlife Act 1976.

The contractor's duties

  • Identify before you dig - survey the site for knotweed and other invasives before groundworks; misidentification and late discovery are the biggest cost drivers.
  • Do not spread it - isolate infested areas and stop machinery tracking contaminated soil across the site.
  • Licence off-site movement - an NPWS licence is required to transport contaminated soil or plant material off-site.
  • Have a management plan - a documented plan protects the programme, the client and the neighbouring properties.

Containment that keeps a site moving

The advantage of physical containment on a construction site is speed: instead of committing ground to 3-5 seasons of herbicide, a site can be developed immediately. Construction FAQs

  • What must a contractor do if knotweed is found on a construction site?
    Stop disturbing the area, isolate it so machinery does not spread it, and put a management plan in place. Any off-site movement of contaminated soil needs an NPWS licence. Containment with a root barrier often lets the build continue on programme.
  • Can we build on a site with Japanese knotweed?
    Yes, with the right containment. Encapsulating infested soil in C3 Root Barrier and building containment cells can make a site immediately available for development, avoiding years of herbicide treatment - provided the work is done correctly and legally.
  • Is a licence needed to move knotweed-contaminated soil?
